摘要
本文作者认为,以德国联邦最高法院为代表的欧洲多数国家的法院,在有关国际条约解释的司法实践当中已经出现所谓去实证化倾向,即不再将已经本国批准的国际条约看成本国国内法体系的组成部分,而是以国际条约在各缔约国的统一适用为目标,在各缔约国的协同意志、条约文本和历史材料、待解释条约与其他条约之间的关系等因素的基础之上寻求条约的自治解释。最后作者还总结了对条约自治解释具有重要意义的"一般法律原则"的发展情况,并分析了其在各国司法实践当中得到适用的可能性。
The author believes that the decisions of the Supreme Court of Germany and the courts of other European countries concerning the interpretation of international conventions in the 20th century have proved a depositive tendency aiming at the harmonious application of the conventions among the ratifying countries. He analyzes the different methods of autonomous-comparative interpretation of international conventions in these countries and predicts their further development.
