摘要
当前刑事司法视野内应用大数据的主要思路着重于'数据'本身的价值,缺少对大数据思维的源头接驳和应用框架的体系性设计,本文根据应用实例,分析和总结了在刑事司法相关数据的采集、分析、共享、保护等框架结构中存在的多个断裂层。针对于此,从大数据混杂性、相关性、记忆性等特性出发,理清大数据思维与刑法应用思维的多个内在逻辑博弈关系,通过SWOT分析法对刑事信息资源的应用情况进行归纳,从四个维度上建构和完善大数据在刑法中的整体性应用框架。
Absrtact:The main idea of applying big data in the field of criminal justice at present focuses is on the value of'data'itself,lacking the systematic design of the source connection and application framework of big data thinking.According to the application examples,this paper analyzes and summarizes several fracture layers in the frame structure of criminal justice related data collection,analysis,sharing and protection.In view of this,starting from the characteristics of big data mixing,relativity and memory,this paper clarifies the multiple internal logical game relations between big data thinking and criminal law application thinking,summarizes the application of criminal information resources through SWOT analysis,and constructs and improves the overall application of big data in criminal law from four dimensions.
