摘要
由于边境后监管分化所导致的非关税壁垒阻碍国际贸易的发展,国际监管合作成为近年来贸易协定谈判的新议题。WTO代表的多边贸易机制在国际监管合作议题上几乎没有新的进展,区域和双边自由贸易协定成为国际监管合作规则发展的次优选择。在CETA、TPP和TTIP等新一代国际贸易协定中,国际监管合作规则从"负面一体化"转向"正面一体化",并以"善治的监管"为核心,以实现国际监管协调或一致。中国应当关注国际监管合作规则的发展动向,并在"一带一路"倡议下积极推动国际监管合作。
As non-tariff trade barriers( NTBs) resulted from the divergence of behind-theborder regulatory rules are the impediment to the development of international trade,international regulatory cooperation has become a new issue in the international trade negotiation in recent years. Meanwhile,owing to the fact that almost no new progress is achieved from the multilateral trade mechanism led by the WTO,bilateral and regional free trade agreements( FTAs) have become the second-best choice for the development of rules of international regulatory cooperation.For the purpose of realizing the regulatory coherence,those concrete rules embedded in some FTAs of new generation,such as CETA,TPP and TTIP,are made with the guidance of a new thought of "positive integration " changed from "negative integration ",and "good regulatory practice"clause stands in the core status of them. China should pay more attention to the new development of rules of international regulatory cooperation and actively promote international regulatory cooperation under "One Belt One Road"initiative.
