摘要
伴随互联网行业的迅猛发展,2015年3月,李克强总理在政府工作报告中首次提出'互联网+'行动计划,互联网已然成为现代社会中人们日常生活不可或缺的重要组成部分。互联网金融自其诞生到飞速扩张发展,备受人们关注。在互联网金融行业扩张发展的同时,也伴随着一些隐患,如金融客户个人信息被泄露、金融账户信息被窃取、账户资金被盗用等问题层出不穷。在互联网时代下对金融隐私权的保护应当受到足够的重视,否则将会制约互联网金融的发展。本文通过对金融隐私权基本理论的阐述,结合我国目前相关法律保护制度,对比国外金融隐私权法律保护的先进经验并扬长避短,为我国的金融隐私权法律保护的完善提出合理建议。
With the rapid development of the Internet industry,in March 2015,Premier Li Keqiang first proposed the'Internet+'action plan in the government work report.The Internet has already become an indispensable part of modern society.Since its inception to rapid expansion,Internet finance has attracted much attention,but the development of the Internet financial industry is also accompanied with some hidden dangers.Financial customer information is leaked,financial account information is stolen,and account funds were stolen.In the era of the Internet,the protection of financial privacy should be taken seriously,or it will restrict the development of Internet finance.Based on the elaboration of the basic theory of financial privacy and the current legal protection system in China,this paper puts forward some reasonable suggestions on the improvement of the legal protection of financial privacy right in China compared with the advanced experience and weaknesses of legal protection of foreign financial privacy right.
