摘要
我国现行结婚登记制存在弊端。欠缺形式要件的事实婚姻长期大量存在,使得我国在司法解释上、实践中及现行立法中,对其效力的认可一直持谨慎甚至妥协的态度,这是一种对结婚必须登记的挑战。借鉴外国婚姻家庭法的可取之处,完善我国结婚程序,立法上宜采用结婚登记或仪式公告制,以及上门服务制。
The current marriage registration system of our country has some disadvantages. The existence of a great number of actual marriages with no formal conditions makes our country adopt a cautious and even compromising attitude toward the effectiveness of judicial interpretation, in practice and in current legislation which is a challenge to marriage registration. Using the advantages of foreign marriage and family laws for reference, it's appropriate to adopt a system of marriage registration or ceremony proclamation and a system of delivering services to the doorstep to perfect marriage procedure in our country.
