摘要
对行政立法制度实施控制 ,是行政法治的基本要求。其中通过程序的设置对行政立法进行过程控制尤为必要。建立“公正优先 ,兼顾效率”的行政立法程序模式 ,是实现对行政立法权有效控制的必然选择。要实现行政立法程序公正与效率的价值追求 ,行之有效的民主参与和立法公开将是目标实现的制度保障。
To control the administrative le gislation is the basic requirements for rule by law, among which the establishment of procedure becomes especially n ecessary. To establish a pattern of the proced ure of administrative legislation, which takes priority for justice, giving con sideration to efficiency is a certa in choice to realize the efficient control o f the power. In order to achieve the values of justice and efficiency of procedur e of administrative legislation, ef fective democratic participation of the publ ic and the open process of the legislation is the system atic safeguard.
