摘要
本文从高校管理与学生权利冲突的案例出发,分析了冲突的具体原因,阐明了高校在有法可依的情况下仍然违法的事实,并以该事实为启示,提出了高校管理在既有自主制定程序的责任,又有担任执行者的权利的双重身份下,必须在良法的基础上做到善治,修好良法与善治的必修课。
