摘要
为期三年的扫黑除恶专项斗争的重要任务之一就是铲除恶势力,恶势力的认定是司法机关特别是公安机关首要解决的问题,为此两院两部联合发布了关于办理黑恶势力犯罪案件的五个规范性文件,对恶势力的惩治提出要求。因为刑事立法未对恶势力进行规定,所以恶势力的认定应当从解析规范文件着手,深入分析恶势力的内涵和特征,从而协调刑法与规范文件相关内容,实现依法严惩的司法目标。依照刑法关于共同犯罪和相关规范性文件的规定,恶势力具有主体上的复杂性、行为上的多元性、危害上的关键性三个特征;恶势力犯罪集团的认定较恶势力更加的具体化,要求其具有组织性、严重的社会危害性。
One of the important tasks of the three-year special campaign against evil is to eradicate evil forces,The identification of evil forces is the primary problem solved by the judiciary,especially the public security organs,For this reason,the two Departments and two Ministries jointly issued five normative documents on dealing with evil forces cases which make requests on the punishments to the evil forces,Because there is not regulation on the punishment to the evil force in criminal legislation,the identification of evil forces should start from the analysis of normative documents,analyze the connotation and characteristics of evil forces in depth,and coordinate the relevant content of criminal law and normative documents to achieve the judicial goal of severe punishment according to law,According to the provisions of the criminal law on joint crimes and related normative documents,the evil forces have three characteristics:complex main body,diversified behaviors,and critical harm;the identification of evil forces criminal groups is more specific,more organizational and harmful than evil forces.
