摘要
本文首先在理论上论述了社会结构变迁对多元纠纷解决机制的影响,然后分析了中国传统乡土社会多元纠纷解决机制保持内在均衡的社会结构根源,最后详细论述了随着中国农村社会结构的巨大变迁,当前农村多元纠纷解决机制所呈现的总体失衡状态,并指出只有优化农村社会结构,才能走出农村纠纷解决的困境。
This paper firstly explains the influence of social structure transition on the multiple dispute resolution mechanism in theory. Secondly it analyzes sources of social structure which made the multiple dispute resolution mechanism in traditional rural China retain inner equilibrium. Finally it detailedly discusses the overall disequilibrium of the multiple dispute resolution mechanism in contemporary rural China along with the great transition of rural social structure. In conclusion,this paper points out that the only way to extricate itself from a plight of dispute resolution in rural China is to optimize rural social structure.
