摘要
新质生产力以创新技术为驱动,深度融合各类质优创新要素特别是数据要素,重塑着当今全球经济发展格局。在加快新质生产力发展中,数据要素因其显著的加乘效应和创新引擎作用,形塑新型生产关系和生产组织方式,构成新质生产力的重要组成部分。数据流通作为连接数据源与数据需求方的桥梁,对于资源高效配置、技术创新开发与应用,以及产业数智化升级至关重要。基于此,亟须推动数据高效流通以更好地释放数据加乘效应。这就需要以动态统筹高质量发展和高水平安全为前提,确保数据在各环节安全流转。目前,数据流通过程中面临着制度供给不足及法律适用性不足等问题,需从政策文件与法律法规的补足与立新上为数据流通提供科学合法有效的指引和规范,确保数据在安全规范流通的同时释放加乘效应,赋能实体经济发展,推动新质生产力稳健发展。
New-quality productive forces,driven by innovative technologies,deeply integrate high-quality innovative elements—particularly data—reshaping the global economic landscape.In accelerating the development of these productive forces,data elements have become a vital component of new-quality productive forces due to their multiplier effects and role as innovation engines,reshaping production relations and organizational models.As a bridge between data sources and data demand,data circulation is essential for the efficient allocation of resources,technological innovation and application,and the digital and intelligent transformation of industries.Therefore,it is imperative to promote efficient data circulation to better unleash its multiplier effects.This requires dynamically coordinating high-quality development with high-level security to ensure the secure flow of data at every stage.Currently,data circulation faces challenges such as inadequate institutional support and insufficient applicability of existing laws.Thus,there is an urgent need to improve and establish relevant policies and legal frameworks to provide scientific,lawful,and effective guidance and regulations.This will ensure that data flows securely and in compliance with standards while unlocking its potential,empowering the real economy,and promoting the stable development of new quality productive forces.
