摘要
妇女权益保障立法体系建设是推进性别平等和人权保障的重要标志,《妇女权益保障法》作为体系中的专门法,起着联动其他部门法相关规定和下位法具体规定的作用。《妇女权益保障法》修订后解决了条款规定抽象、职权划分不清、救济规则缺乏等问题,功能定位由传统的权利倡导转向司法救济。然而,新法实施两年来,司法实践未有吸纳立法体系的功能转变,立法修订亦未对妇女权益纠纷的司法救济产生实质影响。近年来,妇女权益保障面临诸如鼓励生育政策下就业歧视加剧、城镇化进程中土地权侵权案件增多、新业态下劳动权益纠纷等更为复杂的新挑战。这些问题的解决和妇女权益保障的落实亟待健全司法救济制度。在立法体系化建设的契机下,需在合理评估当前司法救济规范特征,归纳分析妇女权益司法纠纷的类型及特点,考察其产生原因和司法救济难点的基础上,提出司法救济路径优化方案,推动妇女权益保障法律体系从法律文本走向司法实践。
