摘要
古代中华法治文明是古代中国为治国理政需要施行法治而逐步形成的法律制度框架和法治思想体系,是中华文明的精华。本文尝试以国家治理模式为视角进行立体分析,以还原古代中华法治文明的整体构造。国家治理模式是以国家治理逻辑起点为基础,以国家治理目标为导向,并在内外部环境约束下建构发展出来的国家治理结构与治理机制之总和。本文从我国古代法治文明的发展脉络、古代法律制度框架和法治思想体系三个方面展开讨论。研究结果表明,我国自西周开始了整体国家的法律建构,以此为基础发展出一整套以国家法、行政法及刑法为主体内容的公法体系,并且这套公法体系渗透到了私域空间。同时,古代法治思想也在不断演进发展,以整体国家观和民本思想为基础,礼法并治,追求客观法秩序与整体和谐,以国家整体利益为价值追求,并形成整体及综合法治思维。古代公法制度框架和法治思想体系互相促进、相互成就,共同铸造出伟大的中华法治文明,支撑和保障了中华文明五千年的绵延传承。
The ancient Chinese civilization of the rule of law refers to the legal institutional framework and the system of legal thoughts that gradually took shape in ancient China to meet the needs of governance and administration through the rule of law.It represents the essence of Chinese civilization.This article attempts to conduct a three-dimensional analysis from the perspective of national governance models,aiming to reconstruct the overall structure of ancient Chinese civilization of the rule of law.The national governance model is the sum total of national governance structures and mechanisms that are constructed and developed based on the logical starting point of national governance,guided by national governance goals and constrained by external environments.This article discusses the development of ancient Chinese civilization of the rule of law from three aspects:the historical trajectory of ancient Chinese civilization of the rule of law,the framework of ancient legal systems and the system of legal thoughts.The research findings indicate that China began the legal construction of a unified state during the Western Zhou Dynasty,which laid the foundation for the development of a public law system centered on state law,administrative law and criminal law.This public law system permeated private domains.Meanwhile,ancient legal thoughts also evolved continuously,based on the concept of a unified state and the people-oriented ideology,emphasizing the co-governance of rites and laws,pursuing an objective legal order and overall harmony,and valuing the overall interests of the state.This led to the formation of a holistic and integrated legal thinking.The framework of ancient public law systems and the system of legal thoughts mutually promoted and reinforced each other,jointly forging the great Chinese legal civilization and supporting and safeguarding the continuous inheritance of Chinese civilization for five thousand years.
