摘要
伴随电子信息技术的快速发展,电子产品逐渐与人们密不可分,电子信息数据呈爆炸式增长。电子证据作为一种新生证据形态在司法实践中越来越重要,但基于其自身特点,在司法适用中仍面临诸多难题,本文通过剖析电子证据的概念及特点,解读其具有法律效力的原因,寻找其在实践中存在困境并提出可行的建议,以期电子证据在实践中发挥其应有的作用。
With the rapid development of electronic information technology,electronic devices have become indispensable to daily life,leading to an exponential surge in digital data.As an emerging form of evidence,electronic evidence is gaining increasing significance in judicial practice.However,due to its inherent characteristics,it still faces multiple challenges in legal application.This paper analyzes the conceptual framework and distinctive features of electronic evidence,interprets the legal validity underpinning its evidentiary status,identifies practical dilemmas in its implementation,and proposes feasible recommendations to ensure that electronic evidence fulfills its due role in judicial proceedings.
