摘要
从合同管理的视角出发,深入分析了国际工程总包项目(EPC/EPCI)的特征、风险分配、风险表现形式及管理要点。通过案例分析,揭示了合同条款不明确、合同结构不当,以及合同支付比例设置不合理等问题对项目执行产生的深远影响。提出了基于FIDIC合同条款的风险管理框架,涵盖了严格的合同审查、标准合同范本的应用、技术与商务的交叉审核、程序化合同管理,以及合同交底等核心环节。研究结果表明,科学的合同管理能够显著提升项目风险管理能力,确保项目成功交付并实现预期经济效益。最后,提出了对合同管理的针对性建议与未来展望,旨在为企业提升国际竞争力、迈向国际一流总承包商提供理论支撑与实践指导。
This paper,from the perspective of contract management,provided an in-depth analysis of the characteristics,risk allocation,risk manifestations,and key management points of international engineering,procurement,and construction(EPC/EPCI)projects.Through case studies,it revealed the profound impact on project implementation caused by issues such as ambiguous contract clauses,improper contract structure,and unreasonable contract payment ratio settings.A risk management framework based on FIDIC contract clauses was proposed,covering core elements such as rigorous contract review,application of standard contract templates,cross-checking of technical and commercial aspects,procedural contract management,and contract briefing.The research results indicate that scientific contract management can significantly enhance project risk management capabilities,ensuring successful project delivery and the achievement of expected economic benefits.Finally,targeted suggestions and future prospects for contract management are put forward,aiming to provide theoretical support and practical guidance for enterprises to enhance their international competitiveness and become world-class general contractors.
