摘要
在“遵义市规范畜禽养殖用药专项整治行动”专项检查中,发现“某某”兽药销售公司有10余t“某某”牌牛胃药产品及部分销售凭证和台账记录,经兽药监管部门认定,按照假兽药处理,为“当事人经营应经审查批准而未经审查批准即生产的兽药”。市农业农村局执法人员按照程序立案后,对案件进行深入调查,按照处罚依据,结合实际,经讨论决定在违法程度严重情节的基础上对处罚金额减轻处理,即没收全部违法经营产品“某某”牌牛胃药;没收违法所得645元;处罚款14万元;吊销兽药经营许可证。通过对这一起假兽药认定,案件调查、分析和处罚,及案件引发的思考,为兽药监管部门、农业执法人员提供参考。
In the special inspection of the“Zunyi City Standardized Livestock and Poultry Breeding Drug Use Special Rectification Action”,it was found that the“XXX”veterinary drug sales company had more than 10 tons of“XXX”brand bovine stomach medicine products and some sales vouchers and ledger records.After being identified by the veterinary drug regulatory department,they were treated as fake veterinary drugs and were classified as“veterinary drugs produced without examination and approval by the parties involved”.Afterfiling the case according to the procedure,the law enforcement personnel of the Municipal Agriculture and Rural Bureau conducted a thorough investigation of the case.Based on the punishment basis and combined with the actual situation,after discussion,it was decided to reduce the punishment amount on the basis of the severity of the illegal situation,that is,to confiscate all the illegally operated products of“XXX”brand bovine stomach medicine;Confiscate illegal gains of 645 yuan;Impose afine of 140 thousand;Revoke the veterinary drug business license.Through the identification,investigation,analysis,and punishment of this fake veterinary drug case,as well as the reflections triggered by the case,provide reference for veterinary drug regulatory departments and agricultural law enforcement personnel.
