摘要
外国仲裁裁决在中国的承认与执行情况如何?《纽约公约》是否在中国得到了全面而正确的贯彻?中国法院拒绝承认与执行外国仲裁裁决的具体理由是什么?本文紧紧围绕这三个问题展开,从中国法院的司法实践角度,指出中国已经建立了相对完善的承认与执行外国仲裁裁决的法律制度,《纽约公约》在中国得到了正确实施,中国法院拒绝承认与执行外国仲裁裁决的比例不高,理由分散但又相对集中,部分法律制度需要进一步完善。
How do Chinese courts recognize and enforce foreign arbitral awards,whether the New York Convention has been implemented properly and what are the specific reasons for denying the foreign arbitral award in China?These three issues are analyzed and discussed in this thesis from the juridical prac-tice of Chinese courts.It can be concluded that china has established a completed legal system to recognize and enforce foreign arbitral awards relatively,the New York Convention has been implemented properly by Chinese courts,the rate of denying foreign arbitral awards is not so high,the specific reasons for denying the foreign arbitral awards are scattered and gathered to some sense,and some rules and regulations demand further improvements.
