摘要
为进一步提升专利开放许可的实施成效,增强知识产权对新质生产力发展的助推作用,本文开展了区域化专利开放许可的范式探索与讨论。区域化专利开放许可依托地方区域平台与专利权人签署协议,通过“集体采购”方式批量获取专利实施许可权,并将这些专利以免费开放的形式授权给区域内企业等实体使用。该范式为破解成果供给方专利转化难和技术需求方技术获取难的“两难”问题提供了一种新思路。进一步,本文还探讨了区域化专利开放许可的必要性和可行性,以及专利开放许可实施的发展路径。
To enhance the effect of the patent open license and promote the development of the new quality productivity via intellectual property,the article investigates and discusses the model of regional patent open license.In the model,the regional patent open licenses are obtained through the agreements between local platforms and patent holders,where the local platforms collectively purchase licenses to the relevant patents and grant free open licenses to the enterprises and institutions on the local platforms.The model offers a new approach to overcome the difficulties in technology transfer from both the demand side and the supply side.Further,the article discusses the necessity and feasibility of the regional patent open license and route for developing and implementing patent open license.
