摘要
智慧养老服务作为实施积极应对人口老龄化国家战略的重要举措,是一种依托人工智能、物联网、区块链、虚拟现实等数字技术的新型养老服务模式,能够有效缓解传统养老方式中存在的医疗照护能力不足、养老供给能力欠佳等问题,为老年人提供精准化、个性化、多元化、智能化的养老服务。但由于我国智慧养老服务发展起步较晚,在实践中同时也存在一系列影响高质量发展的立法保障不完善、行政监管不到位、侵权救济不畅通与法治观念不牢固等法治困境。为迎接数字经济对智慧养老服务带来的战略机遇和风险挑战,需要进一步从加快立法跟进、强化行政监管、注重侵权救济和夯实法治观念等方面为智慧养老服务提供坚实法治保障,助推智慧养老服务高质量发展。
As a crucial measure in implementing the national strategy for actively addressing population aging,intelligent elderly care services leverage digital technologies such as artificial intelligence,the Internet of Things,blockchain,and virtual reality.This new model of elderly care effectively alleviates issues inherent in traditional care methods,such as insufficient medical care resources and inadequate supply of elderly care services,and is capable of providing precise,personalized,diverse,and intelligent services for the elderly.However,due to the relatively delayed development of intelligent elderly care services in China,several legal challenges hinder its high-quality development in practice.These challenges include inadequate legislative support,insufficient administrative supervision,ineffective channels for infringement remedies,and weak legal awareness.To seize the strategic opportunities and address the risks posed by the digital economy to intelligent elderly care services,it is necessary to further provide robust legal protection by accelerating legislative advancements,strengthening administrative supervision,focusing on infringement remedies,and consolidating legal awareness,thereby promoting the high-quality development of intelligent elderly care services.
