摘要
法律制度是国家治理的可靠保障,对于推动国家区域协调发展战略具有重要作用。新《立法法》修改实施以来,加强区域协同立法有了坚实的法律依据,对区域协调发展立法保障实施机制的研究也成为重要议题。针对目前协同立法实践普遍存在的缺乏法律强制力、存在合法性漏洞等问题,需要在新《立法法》第83条的宏观制度设计下,确立“建构与自发”二元并重的立法模式,并因时因地深化区域间“差异化合作”。区域协调发展立法保障需要遵循平等协商原则、共同但有区别原则以及合宪合法性原则,规范区域协调发展立法保障的组织机构,探索建立重大立法项目协调公关机制、利益协调补偿机制和协同立法的审查机制三项实体性机制,建立完善立法信息联动和共享机制、协同立法规划磋商制定机制和冲突法规及规范性文件清退机制三项程序性机制,引领和推动区域协调发展战略行稳致远。
The legal system is a reliable guarantee for national governance and plays an important role in promoting the national strategy for coordinated regional development.Since the revision and implementation of the new Legislative Law,there is a solid legal basis for strengthening regional coordinated legislation,and the study of the implementation mechanism of legislative guaran-tee for regional coordinated development has become an important issue.In view of the lack of legal coercion,the existence of le-gitimacy loopholes,and the dependence on local politicians for concrete implementation,etc.,which are common in the current practice of coordinated legislation,it is necessary to establish a dualistic legislative model of"construction and spontaneity"un-der the macro system design of Article 83 of the new Legislative Law,and deepen the"differentiated cooperation"among the re-gions in accordance with the time and place."Differentiated cooperation".The legislative guarantee for regional coordinated de-velopment needs to follow the principle of equal consultation,the principle of common but differentiated,and the principle of constitutionality and legality,regulate the organization of the legislative guarantee for regional coordinated development,explore the establishment of the three substantive mechanisms of coordinating the public relations mechanism for major legislative pro-jects,the mechanism of compensating for the coordination of interests,and the mechanism of reviewing the coordinated legisla-tion,and set up and improve the mechanism of linking and sharing of legislative information,the mechanism of coordinating the consultation of the legislative planning,and the mechanism of clearing the conflicting regulations and normative documents.It has also established and improved three procedural mechanisms,namely,the mechanism for linking and sharing legislative informa-tion,the mechanism for consulting and formulating coordinated legislative plans,and the mechanism for clearing conflicting regu-lations and normative documents,so as to lead and promote the strategy of coordinated regional development in all aspects.
