摘要
近年来,全国法院执行案件“收案数”持续高位运行,从源头上减少执行案件势在必行,也是向“切实解决执行难”目标迈进的现实需要。虽然全国各地法院在体制机制、内外联动、立审执配合、机构改革等方面探索和积累了经验,从源头上解决执行难取得阶段性成效,但是,仍然存在机制不够健全、协同不够高效、法规不够完善等实践问题。应坚持“当下治”和“长久立”相结合,加强“切实解决执行难”路径的顶层设计,优化源头治理的实践路径,以“时间表”明确时限要求,以“路线图”指引步骤方法,减增量、提质量、增效率,深入推进人民法院执行工作现代化。
In recent years,the"number of enforcement cases received"by courts nationwide has continued to operate at a high level.It is imperative to reduce enforcement cases from the source,which is also a practical need to move towards the goal of"effectively solving enforcement difficulties".Although courts across the country have explored and accumulated experience in institutional mechanisms,internal and external linkage,cooperation between legislative,judicial and executive branches,and institutional reform,and have achieved phased results in solving difficulties in enforcement from the source,there are still practical problems such as inadequate mechanisms,inefficient collaboration,and incomplete regulations.We should adhere to the combination of"current governance"and"long-term establishment",strengthen the top-level design of the path of"effectively solving difficulties in enforcement",optimize the practical path of source governance,clarify the time limit requirements with a"timetable",guide the steps and methods with a"roadmap",reduce increment,improve quality,and increase efficiency,and deepen the modernization of people's court enforcement work.
