摘要
海牙国际私法会议作为国际民商事诉讼领域最具影响力的国际组织,正努力通过直接管辖权项目协调各国在管辖权问题上的矛盾。考虑到现阶段针对直接管辖权的所有内容制定约束性文书存在困难,各方仅就制定平行诉讼约束性文书达成了初步共识。至于平行诉讼约束性文书的具体框架与内容,仍待进一步讨论。我国作为世界大国,必将深度参与平行诉讼约束性文书的制定过程。为确保我国参与国际谈判时享有充分的法律基础,有必要尽快完善与涉外平行诉讼有关的现有规范,限制立法放任平行诉讼的立场,优化不方便法院原则的适用规则,建立有限度的禁诉令及配套制度。
As the most influential international organization in the field of international civil and commercial litigation,Hague Conference on Private International Law is trying to coordinate the conflicts between countries on jurisdictional issues through the jurisdiction project.Considering that it is difficult to formulate a binding document for all the contents of direct jurisdiction at this stage,the parties have reached a preliminary consensus only on the on the formulation of binding documents for parallel litigation.As for the framework and content of the binding documents for parallel litigation,it still needs further discussion.As a large country,China will deeply participate in the process of formulating binding documents for parallel litigation.In order to ensure that China have a sufficient legal basis to participate in international negotiations,it is necessary to improve the legal provisions related to parallel litigation as soon as possible,including restricting the indulgence of parallel litigation,improving the applicable rules of forum non conveniens,and establishing the limited anti-suit injunction system.
