摘要
民族自治地方对口支援的法律规范不是传统法理上主要适用于司法实践活动的“行为规范”,而是需要国家机关作为义务主体积极作为、并通过立法裁量和行政裁量具体化立法意图的“目标规范”。民族自治地方对口支援法律规范的“目标规范”属性决定了其“授权规范”的实施机制,即其实施依靠低位阶的法律性文件和规范性文件加以具体化:通过最高层级的规范(宪法)向低层级法律规范“授权”,最终产生出一个“行为规范”的形式来获得实施。实践中,民族自治地方对口支援法律规范,依靠科层制下目标任务的层层细化、最终通过地方政府的具体化措施加以推进实施,其实践逻辑契合了法理上“目标规范”的“授权规范”实施机制。
The norms of Matching Support System in Ethnic Zizhi Areas are not the“norms of conduct”which is mainly used in judicial practice in traditional jurisprudence,but the“aspirational norms”which requires the state organ to act actively as the subject of obligation and specify the legislative intention through the form of legislative and administrative discretion.The“aspirational norms”attribute of the counterpart support norms in Ethnic Zizhi Areas determine the implementation mechanism of their“authorization norms”.The implementation of the Counterpart Support System in Ethnic Zizhi Areas relies on low-level legal documents and normative documents to be concretized,that is,through the highest level of norms(constitution)to authorize norms at the lower level,and finally produce a form of“behavior norm”to be implemented.In practice,the implementation of the MSY in Ethnic Zizhi Areas relies on the layers of refinement of goals and tasks under the bureaucratic system,and finally the implementation of the local government is concretely promoted,and its practical logic conforms to the implementation mechanism of the“authorization norm”of the“aspirational norms”in the legal theory.
