摘要
海洋在新时代下被赋予了丰富的理论意蕴与多元的实践价值。我国海洋牧场作为海洋的一个重要面向,既是海洋经济发展的重要场域,又是海洋生态文明建设的必要环节,也是海洋强国建设的组成部分。我国海洋牧场既需要全面科学保护,又需要合理开发与适度利用。对我国海洋牧场进行地方立法有利于实现海洋牧场管理的有规可依,有助于规范海洋牧场的开发利用,有益于提升海洋牧场环境保护工作的成效。我国海洋牧场地方立法的重点内容主要包括:立法理念上的生态优先、监督管理上的分工配合、规划编制上的科学合理、投入机制上的多元并存、开发经营上的有力保障。我国海洋牧场地方立法只有“立得住、行得通、真管用”,才能行稳致远地促进地方发展和服务本地民生。
In the new era,the ocean has been endowed with rich theoretical connotations and diverse practical values.As an important aspect of the ocean,China's oceanic pastures are not only an important field for the development of the ocean economy,but also a necessary link in the construction of ocean ecological civilization,as well as a component of the construction of a strong ocean state.China's oceanic pastures need not only comprehensive scientific protection,but also reasonable development and appropriate utilization.Local legislation on China's oceanic pastures is conducive to the implementation of regulations for oceanic pastures management,helps to regulate the development and utilization of oceanic pastures,and is beneficial to improve the effectiveness of oceanic pastures environmental protection work.The key content of the local legislation for oceanic pastures in China should include:ecological priority in legislative concepts,division of labor in supervision and management,scientific and reasonable planning,coexistence of multiple input mechanisms,and strong development and management.Only if the local legislation of oceanic pastures in China is"reliable,feasible,and effective",can it promote local development and serve local people's livelihood steadily and far.
