摘要
《中华人民共和国刑法修正案(十一)》将“高空抛物罪”独立成罪,高空抛物罪从危害公共安全类罪名修订为妨害社会管理秩序类罪名,但在实务案件中高空抛物行为以危险方法危害公共安全定罪的适用率较高,这导致定罪量刑的不当。同时罪名的变更导致侵害的法益也随之变化,高空抛物罪的保护法益由“公共安全”变更为“公共秩序”,两者法益区分成为该类案件司法认定的难点。考虑高空抛物案件实际情形的复杂性,在明确高空抛物罪客观要件的前提下,需要厘清本罪所保护的法益,从而精确运用罪名,防止新罪沦为“口袋罪”,在不违背刑法谦抑的前提下有效应对高空抛物行为。
Throwing Objects From High Altitude is judged as a separate crime in the Criminal Law Amendment(11)and throwing objects from a height is also revised from a crime endangering public safety to the crime of impairing social management order.However,in practice,the applicable rate of conviction of throwing objects from high altitude endangering public safety in dangerous ways is still high,causing improper conviction and sentencing.At the same time,the change of the accusation leads to the change of the legal interests of the infringement.The protection of the legal interests in the crime of throwing objects from heights has changed from"public safety"to"public order".The distinction between the two legal interests has become a difficult point of judicial determination in such cases.Considering the complexity of the actual situation of throwing objects from a height,this paper aims to clarify the objective elements in the crime of throwing objects from a height,clarify the legal interests protected by the crime,so as to accurately apply laws to the crime,prevent the new crime from becoming a"pocket crime",and effectively prevent the act of throwing objects from a height without violating the premise of criminal law modesty.
