摘要
绵延五千年的中华法文化内涵丰富,时至今日其中蕴含的价值理念仍具有重要的理论意义和现实意义。中华法文化价值理念主要有:民为邦本的民本理念;德主刑辅的德法共治理念;实用主义的经世致用理念;公平正义的法律公平理念;以法治官的权责统一理念等。中华法文化价值理念既为社会主义法制建设提供历史借鉴,也为建设中国特色社会主义法制体系、全面推进依法治国提供坚实的学理支撑。当下,赓续与传承优秀中华传统法文化对新时代法治建设大有裨益。
There exist rich connotations in the 5000-year-long Chinese legal culture,and the values and concepts contained therein still have strong practical significance to this day.The value concept of Chinese legal culture is mainly reflected in the people-oriented concept,the concept of co-governance of morality and law,the concept of pragmatism,the concept of legal fairness and justice by moderation and the concept of governing officials by law and clarified responsibilities.Continuing and inheriting the excellent traditional Chinese legal cultural values is of great benefit to the law construction in the new era.
