摘要
诚实信用原则不断超越民商事法律逐渐扩大到诸多法律领域,作为劳动合同法的基本原则,弥补劳动立法缺陷、化解劳动纠纷。然而诚实信用原则的抽象性、道德性使其难以在实践中系统、科学地应用。通过梳理劳动纠纷裁判文书,发现诚实信用原则在适用标准、适用条件、适用底线等方面存在问题。结合我国实际提出统一指导案例裁判标准、明确适用条件和限定适用边界的法律建议。更好地完善诚实信用原则,提升劳动者和用人单位双方诚实信用水平,推动信用社会建设。
The principle of honesty and credit continues to surpass civil and commercial laws and gradually expands to many legal fields.As a fundamental principle of labor contract law,it compensates for labor legislative deficiencies and resolves labor disputes.However,the abstract and moral nature of the principle of good faith makes it difficult to apply it systematically and scientifically in practice.By sorting out labor dispute adjudication documents,it was found that there are problems with the principle of good faith in terms of applicable standards,conditions,and bottom lines.Based on the actual situation in our country,propose legal suggestions for unified guidance of case judgment standards,clear application conditions,and limited application boundaries.Better improve the principle of honesty and credibility,enhance the level of honesty and credibility of both workers and employers,and promote the construction of a credit society.
