摘要
基于《民法典》对于环境人格利益的保护仍处于初步探索阶段,未能正面回应环境人格权的立法确认问题,导致环境人格利益得不到全面的保护。建议通过司法解释的方式,对环境人格利益的权益保护范围、妨碍的判断标准、救济体系等进行设计,从而构建体系化的环境人格利益私法保护模式。
Based on the fact that the protection of environmental personality interests in the Civil Code is still in the initial exploration stage,it fails to respond positively to the issue of legislative confirmation of environmental personality rights,resulting in a lack of comprehensive protection of environmental personality interests.It is suggested that the scope of protection of rights and interests of environmental personality interests,the criteria for judging obstacles,and the relief system should be designed through judicial interpretation,so as to build a systematic protection mode of private law for environmental personality interests.
