摘要
区块链存证的运用一定程度上弥补了电子数据在真实性审查方面的不足,但是囿于相关规范的缺失,司法实践中关于电子数据区块链存证的效力认定还存在真实性审查极端化及标准模糊性、缺少必要的关联性与合法性审查等问题。在现有规范无法为司法实践提供充分指引的情况下,有必要依托“证据三性”审查规则,结合证据法原理与区块链存证的技术特性,将原先融合一体的混合式审查方式转变为分离式审查模式,区分真实性、关联性、合法性,按照证据三性规则进行分角度分层次的效力认定。
The application of blockchain certificate makes up for the deficiency of electronic data authenticity to some extent.However,being limited by the deficiency of relevant norms,there are still some issues in judicial practice concerning the validity verification of electronic data block chain certificate,such as the extreme authenticity review,the ambiguity of standards,the lack of necessary relevance and legitimacy review.In the case that the existing norms cannot provide sufficient guidance for judicial practice,it is necessary to rely on the“three characteristics of evidence”review rules,combine the principle of evidence law and the technical characteristics of blockchain storage,transform the original integrated hybrid review mode into a separate review mode,distinguish the authenticity,relevance and legitimacy,and conduct the validity verification according to the three characteristics of evidence rules from different perspectives.
