摘要
作为国家发展的战略性资源和国际竞争力的核心要素,知识产权在全球化竞争战略中发挥重大作用。随着我国外向型经济水平不断提升,越来越多的企业参与国际竞争,但由于海外知识产权风险防控不到位、发达国家知识产权贸易壁垒和纠纷应对机制不健全等因素,导致海外知识产权纠纷不断增多而且败诉率较高。针对上述问题,政府应从战略高度为企业应对海外知识产权纠纷提供风险预警;企业应注重海外知识产权布局,不断提升自身应对法律风险的能力;行业协会应发挥社会组织职能作用,提升知识产权服务水平。
As a strategic resource for national development and a core element of international competitiveness,intellectual property plays an important role in the strategy of global competition.With the continuous improvement of China’s export-oriented economy,more and more enterprises are participating in international competition.However,due to the lack of inadequate prevention and control of overseas intellectual property,the intellectual property trade barriers and imperfect dispute response mechanisms in developed countries,overseas intellectual property disputes are increasing and the rate of losing lawsuits is high.In view of the above problems,the government should provide early risk warning for enterprises to deal with overseas intellectual property disputes from a strategic perspective;enterprises should pay attention to the layout of overseas intellectual property and constantly improve their ability to deal with legal risks;industry associations should play the role of social organizations and improve the level of intellectual property service.
