摘要
地理标志是我国知识产权中的一个重要组成部分。结合贵州白酒发展的实际情况,从地理标志注册数量及地域分布、地理标志保护基本情况、地理标志相关法规等方面,对贵州白酒地理标志保护现状进行分析。梳理贵州白酒地理标志保护存在的不足,发现地理标志保护机构不统一、忽视质量和品质特征、监管和追溯力度不够、地理标志保护意识淡薄等问题。提出从法律方面强化地理标志保护机制、提高地理标志保护意识、提升白酒地理标志产品品牌度等建议,有助于优化贵州地理标志保护机制和管理制度,提高地理标志品牌知名度和影响力,推动当地特色产业发展。
Geographical indication is an important component of intellectual property rights in China.Based on the actual situation of the development of Guizhou Baijiu,this study analyzes the current situation of the protection of Guizhou Baijiu geographical indication from the aspects of the number and distribution of geographical indication registrations,the basic situation of geographical indication protection,and the relevant regulations of geographical indications.The study identifies shortcomings in the protection of geographical indications for Guizhou Baijiu,including the lack of unified geographical indication protection institutions,the neglect of quality and characteristic features,insufficient regulation and traceability,and a weak awareness of geographical indication protection.Suggestions are proposed to strengthen the mechanism of geographical indication protection from a legal perspective,enhance the awareness of geographical indication protection,and improve the branding of geographical indication products for Guizhou Baijiu,which can help optimize mechanisms and management systems,increase brand awareness and influence,and promote the development of local characteristic industries.
