摘要
涉案企业合规适用范围是涉案企业合规制度中至关重要的一环,其决定了合规制度改革的深度和广度。我国试点改革期间,检察机关对涉案企业合规案件适用范围进行了一系列本土化改造,在此过程中,实务界和理论界对于涉案企业合规能否适用于小微企业,涉企犯罪自然人、重罪案件等问题仍存在诸多争议,对此,必须在借鉴域外经验,并结合我国实际情况的基础上,围绕涉案企业合规适用的企业类型、对象、案件范围和条件进行整体设计。
The scope of compliance application of the enterprises involved in the case is a crucial part of the compliance system of the enterprises involved,which determines the depth and breadth of the reform of the compliance system.During the pilot reform period in China,the procuratorate carried out a series of localized reforms on the scope of application of enterprise compliance cases.During this process,there are still many disputes between the practical and theoretical circles about whether the enterprise compliance can be applied to small and micro enterprises,natural person and felony cases involving crimes,etc.Therefore,we must learn from foreign experience and combine the actual situation of China so as to carry out the overall design around the enterprise type,object,case scope and conditions applicable to the enterprise involved.
