摘要
晚清民国江西赣南房产契约中有很多地方惯习,如对房屋、地基等房产产权要素的说明,产权边界的规定,以及对公共空间、公共设施的处理等,这些惯习也是地方法秩序的一部分,它们对房产买卖起着规定作用,这些惯习在其他省份有不同的表现。明清以来的城市房产交易研究还有很大的空间,随着更多城市房产契据的整理与出版,房产契约研究将得到学术界的更多关注。
There are many local customs in the contracts of real estate of Southern Jiangxi Province in late Qing Dynasty and the Republic of China,such as the summarization of property right,the definition of house estate boundary,the transaction of public space and facilities,and so on.These customs are parts of local law order.These customs influence house transaction a lot.There are different representations of these customs in other provinces.There are many themes about house estate transaction need to study from Ming and Qing dynasties.Many contracts and documents have been published these years.Great importance will be attached to the house property transation.
