摘要
国际体育仲裁员的公正性对仲裁庭组成、裁决的效力和运动员公平审判权等方面产生诸多影响。具体案件分析中,影响国际体育仲裁员公正性的事由可以区分为身份冲突和个人行为冲突。国际体育仲裁员公正性面临当事人难以获取有效线索和缺乏客观判断标准的现实困境。因此,确保国际体育仲裁员公正性可以从仲裁员应当披露可能影响其公正性的事由、当事人对仲裁员公正性进行必要的背景调查、完善“合理怀疑”的客观判断标准三方面予以完善。
The impartiality of international sports arbitrators has effects on the composition of the arbitration tribunal,the effectiveness of the award and the fair trial rights of athletes.In the analysis of the specific cases,the reasons that affect the impartiality of international sports arbitrators can be divided into identity conflicts and personal behavior conflicts.The impartiality of international sports arbitrators faces the practical dilemma of the parties’difficulty in obtaining effective clues and lack of objective judgment standards.Therefore,to ensure the impartiality of international sports arbitrators can be improved from the following three aspects.The arbitrator should disclose the reasons that may affect the impartiality of the arbitrator.The parties conduct the necessary background investigation on the impartiality of the arbitrator.The objective judgment standard of“legitimate doubts”should be improved.
