摘要
《中华人民共和国监察法实施条例》调整了相关留置措施规则,更具可操作性。在监察实践中,留置措施在以下三个方面还有待完善:严重职务违法行为和职务犯罪行为留置适用未作区分,留置措施规则内容不明确,留置措施司法衔接监督机制有待完善。明确留置措施的性质,细化留置措施规定,完善司法衔接监督机制,是解决上述问题的关键。
The Regulations on the Implementation of Supervision Law of the People's Republic of China have improved the rules for the use of lien measures,and its theoretical basis has been further improved.However,there are still some problems in the practice of lien measures:there are no differentiated provisions on the use of lien measures for serious duty illegal acts and duty crimes,and the rules and details of lien measures,namely the legal cohesion mechanism,need to be improved.The key to solve the above problems is to clarify the nature of the lien measures,to refine the provisions of the lien measures,to implement the connection mechanism between supervision and judicature stipulated by law,and to enrich the connotation of supervision and supervision.
