摘要
传统医药知识蕴含大量未被发掘的医药成分,对我国医药研发和全人类的健康发展有着重要意义,是中华民族重要的智力成果,但现有知识产权框架不能为其提供充分有效的保护。为防止他国医药开发者的"生物剽窃"与传统医药知识的流失,有必要突破现有知识产权体系,将传统医药知识列为知识产权特殊客体进行保护。设立区别于一般知识产权主体、客体和内容的特别权利——"传统知识权",围绕其制定专门法,并充分利用现有商标、专利制度,有效落实惠益分享,帮助部分传统社区精准脱贫,同时为解决全球医学难题、构建人类命运共同体贡献一份力量。
Traditional medical knowledge contains a large number of undiscovered pharmaceutical ingredients, which is of great significance to China’s pharmaceutical research and development and the healthy development of mankind. It is an important intellectual achievement of the Chinese nation, but the existing intellectual property rights framework cannot provide sufficient and effective protection. In order to prevent bio-piracy from other countries and the loss of traditional medicine knowledge, it is necessary to break through the existing intellectual property system and protect traditional medicine knowledge as a special object of intellectual property. We need to set up sui generis right---"traditional knowledge right",which has different subject, object and content from general intellectual property rights-, center this right to formulate a specific law, and make full use of the existing system of trademark and patent, so as to implement benefit-sharing system,help some traditional communities out of poverty, and contribute to solving global medical problems and building a community with a shared future for mankind.
