摘要
家父权无论在东西方古代都是相当重要的权利。宗法伦理制度和儒家思想赋予了中国古代家长对子女的控制权。而在古罗马,罗马法以法律的手段确认并保障了家长,尤其是男性家长对子女从生命权到婚姻财产权多方面的管辖,其力度和严密程度丝毫不逊于中国,也导致了一系列社会问题,其背后更蕴含着罗马社会所普遍推崇的精神以及深层次的人口问题。
Patriarchy was an important right in ancient times in both the East and the West.The patriarchal ethics system and Confucianism gave the ancient Chinese parents control over their children.In ancient Rome,Roman laws confirm and protect parents,especially male parents on the children from the right to life to marital property rights in many aspects of jurisdiction,its strength and strictness is no less than in China,but also led to a series of social problems,including generally respected spirit of Roman society and deep-seated population problems.
