摘要
文中首先基于条例总体、管理体制机制、湿地保护管理、湿地利用管理、湿地修复与生态补偿5个方面共72项指标构建完备程度指数,进一步结合22项严格程度附加指标建立严格程度指数,据此对我国已出台的省级湿地保护法规文本进行评估。结果表明:1)27部省级法规的完备程度指数和严格程度指数均值分别为0.645和0.614,完备程度指数居前3位的分别为江苏、宁夏、北京,严格程度指数前3位分别为江苏、黑龙江、宁夏;2)在单项指标方面,被各省级法规覆盖程度低于1/3的指标主要包括湿地保护目标责任制、上级政府对下级政府的监督、专家咨询与专家委员会、湿地利用一般性规定的违法法律责任、湿地占用分级规定、占补平衡相关指标、项目环境影响评价、受保护的野生动植物的保护管理、湿地修复技术要求、湿地修复责任主体区分等,这些是进一步完善省级湿地保护法规时需重点补充的内容。研究结果可为各省进一步完善湿地保护法规、健全湿地保护制度体系提供参考。
Firstly,this paper constructs a completeness index based on 72 indicators in five aspects:overall regulations,management system and mechanism,wetland protection management,wetland utilization management,wetland restoration and ecological compensation,and further establishes a strictness index combined with 22 additional strictness indicators,so as to evaluate the text of provincial wetland protection laws and regulations in China.The results show that:1)The mean values of completeness index and strictness index of 27 provincial laws and regulations are 0.645 and 0.614 respectively,Jiangsu,Ningxia and Beijing ranks the top three of completeness index respectively,and Jiangsu,Heilongjiang and Ningxia ranks the top three of strictness index respectively;2)The indicators with a coverage of less than 1/3 by provincial laws and regulations mainly include wetland protection target responsibility system,supervision of the superior government over the subordinate governments,experts consultation and expert committee,the legal responsibilities for general regulation on illegal behaviors in wetland utilization,the classified regulations on wetland occupation,the balance of occupation and compensation,the environmental impact assessment of the project,the regulations on protected wildlife,the technical requirements of wetland restoration,and the discrimination for main bodies responsible for wetland restoration,which are the key supplementary contents to further improve the provincial wetland protection laws and regulations.The research results can provide reference for all provinces to further improve wetland protection laws and regulations and improve wetland protection institutional systems.
