摘要
商标品质保障功能缘起于匿名来源理论,并在实践中不断演化和发展。商标品质保障功能是否具有独立性,理论界和实务界存在不同的观点,对该问题的回答需要从理论和实践现状及需求等角度进行分析。从商标品质保障功能的基本内涵、来源识别功能的实现前提以及现代商标法基本宗旨来看,商标的品质保障功能具有独立于基础来源识别功能的价值,可作为判断是否构成商标侵权的理论依据。结合我国现行《商标法》的规定来看,有必要在今后《商标法》修时针对破坏商标品质保障功能类的商标侵权行为进行明确的规定,以更好地保障商标权人的利益。
The Quality Guarantee Function of trademark is derived from the theory of anonymous sources,and has evolved in practice.Whether the Quality Guarantee Function of trademark is independent,there are different views in academic circles and practice circles.The answer to this question needs to be demonstrated from the theoretical level and the current situation and demand.From the three perspective,including connotation of Quality Guarantee Function of trademark,the evolution of source recognition function and the basic purpose of modern trademark law,the Quality Guarantee Function of trademark has independent value relative to the basic source recognition function,which can be used as the theoretical basis for trademark infringement judgement.According to Chinese current trademark law,it is necessary to make clear provisions on trademark infringement sabotaging the function of trademark quality assurance when the trademark law is revised in the future.
