摘要
法学教育是法治人才培养的核心基础环节,中国法学教育先后经历了向“北”借鉴苏联、向“东”学习日韩、向“西”参考欧美的重心演变,但鲜有将视野向“南”看。澳大利亚作为南半球经济最发达、法制最健全、法学教育最完善的国家,其改革经验值得借鉴。结构化衔接方面,其构筑了法学教育的十级资格和实践执业的三重过程;国际化因应上,其在课程内容设计上注重比较分析、教学方式上强调创新科技;组织化保障层面,其拥有教育改革促进的外在不同利益群体和教学研究保障的内在系统机制。但缺憾和困境亦在,20世纪末以来随着法学院校急剧膨胀,澳大利亚法学教育过度商业化和律师执业门槛弱化的问题凸显。中国如何择鉴?其一,择其优者而用,从法学教育体系、内容方式和促进主体进行改革式突破;其二,择其忧处而思,在规模限制、课程架构及职业考试方面进行改良式坚守。
Legal education is regarded as the cornerstone in cultivating legal professionals.In China,we have drawn much experiences form Soviet Union in North,Japan in East and Europe as well as US in West,but still lacks the observation from the South Globe,especially the Country Australia.In terms of education certificate structure,Australia builds the ten-level qualifications of legal education and the three-fold process of practical training.With respect to internationalization development,it put emphasis on comparative analysis in designing curriculum contents,and on innovative technology in teaching methods.As regards organizational mechanism,its latest educational reform promotes the effectively cooperative mechanism between external interest groups and the internal related teaching groups..However,there are also shortcomings and dilemmas.With the rapid expansion of law schools since the end of last century,the problems have become prominent that over-commercialization of law education in Australia and the weakening of the threshold for lawyerspractice.This paper suggests that China should draw lessons and experiences from Australia.
