摘要
通过归纳《2006年海事劳工公约》财务担保体系下海员被遗弃情况,总结海员被遗弃特点,从国际公约、船旗国、港口国、海员提供国、船东和海员的角度分析海员被遗弃和造成案件解决困难的原因,提出解决建议,为财务担保体系的完善提供参考。
Based on the study of the abandonment of seafarers under the financial guarantee system of the Maritime Labour Convention 2006,the paper summarizes the characteristics of the abandonment of seafarers and analyzes the causes for the abandonment and the difficulties in settling such cases from the perspective of international conventions,flag States,port States,country of origin of seafarers,shipowners and seafarers,and puts forward suggestions on the solutions,with a view to providing reference for improving the financial guarantee system.
