摘要
类案裁判的推行,旨在统一法律适用标准和规范同类案件裁判尺度。在司法实践中类案裁判面临着类案检索、比对参照和智能辅助方面的挑战。解决问题需要就类案裁判规则的规范化、标准化进行研究。规范化规则分为规范检索范围与步骤、规范分析角度与工具、规范异议讨论机制。通过探索规范化规则,提出构建标准化规则的对策建议,包括类案检索中的案例筛选和分类规则、比对参照中的比对方法和因素考量规则、智能辅助中的理念梳理和机制构建规则。
The implementation of similar cases judgments is aimed at unifying the standards for the application of laws and standardizing the criteria for judgments in cases.In judicial practice,the judgment of similar cases is faced with the difficulties of case retrieval,comparative reference and intelligent assistance.To solve the dilemma,it is necessary to conduct research on the normalization and standardization of judgment rules for similar cases.The normalization rules are divided into the preparation stage of the standard search scope and steps,the analysis stage of the standard analysis angle and tools,and the discussion stage of the standard objection discussion mechanism.Through the exploration of the normalization rules,it proposes countermeasures and suggestions for the standardization construction,including case screening and classification rules in category case retrieval,comparison methods and rules of factors consideration in comparison and reference,and concept combing and mechanisms building of intelligent assistance.
