摘要
国际船东互保协会对海洋重大风险的防控与保障功能不可忽视,其从事的保赔保险保持着全球风险共同性与运营理念传统性。我国船东互保协会的发起和成立有其自身的特点,但运营理念及操作与国际保赔协会保持高度一致。海上保赔保险的法律特性与国内一般相互保险在具体制度层面有明显的差异。因此,船东互保协会在主体性质界定和监管层面应与一般相互保险组织加以区分,而其与会员订立的海上保赔保险合同更具海上保险合同的特征,应在《海商法》修改中明确适用或参照适用《海商法》关于海上保险合同的规定。
The functions of international P&I Clubs in preventing from and protecting against major marine risks can not be ignored.The protection and indemnity insurance provided by the P&I Clubs reflects the common risks in global community and the traditional concept in operation.The establishment of China's shipowners'P&I Clubs has its own unique characteristics,while their operational concept and operation are highly consistent with those of the international counterparts.The specific rules in the marine protection and indemnity insurance differ obviously to those in domestic mutual insurance.This essay starts with the analysis of the unique features of shipowners'protection and indemnity insurance,its domestic characteristics and legal nature of the contract,then discusses the legislation model of marine protection and indemnity insurance in China,with a conclusion that the legal nature of the marine P&I insurance should be identified in amending the China's Maritime Law and that China's Maritime Law should be applied or be referred to marine P&I insurance contracts.Meanwhile,such insurance should be differentiated from the general mutual insurance at the supervisory level.
