摘要
地勘事业单位房产出租实质上是国有资产的有偿使用,涉及国有资产管理、非税收入等众多法规。这些法规本身存在不少模糊的、有争议的地方,造成了实际执行的困难。文章梳理了这些法规的相关条文,分析了法律层级过低、法律体系存在冲突、部分条文含义不清等问题。针对改革政策、制度体系、运行机制方面提出建议,以完善相关法规,改进运行机制,推进行政事业单位国有资产管理领域治理体系、治理能力现代化。
The real estate leasing of geo-prospecting institutions is essentially the paid use of state-owned assets,involving many laws and regulations on the state-owned assets management and non-tax revenue.There are many ambiguous and controversial aspects in these laws and regulations,which cause difficulties in the actual implementation.The paper reviews the relevant provisions of these laws and regulations,and analyzes the problems such as low legal hierarchy,conflict in the legal system,and unclear meanings of some provisions.In order to improve the relevant laws and regulations,improve the operating mechanisms,and promote the modernization of the governance systems and governance capacities in the field of state-owned assets management of administrative institutions,the paper puts forward the suggestions on the reform policies,institutional systems and operating mechanisms.
