摘要
中西方理性观对于处置群体性劳动争议的行为逻辑迥然不同。中国的集体劳动关系制度在西方学者看来很不完善,但不能否认近年来中国大多数的群体性劳动争议通过和平的方式得到了较为迅速的解决。中国地方政府和相关部门的具体处置手段体现了传统儒家的“经权”思想,即通过整体性、动态性、平等有限性、强目的性和法律工具性等权衡方法,力争在每次纠纷处置中达到“恰到好处”的结果,以实现中央对于地方构建“和谐劳动关系”的期望。这种处置理念符合中国人独特的理性观与是非标准,在实践中具有灵活、高效的优势,然而也存在可能被错用、滥用,以及过度依赖执行人等弊端。
From the perspective of western legal system,the collective labor legal system in China is far from perfect.Relevant laws are vague,weak and too general and there is no sound collective bargaining system in China as in the western democratic constitutional states.However strangely enough,during the over thirty years since the implementation of the Reform and Opening-up policy,most of the labor disputes in China were solved in a peaceful way.No large-scale social unrests were aroused.The rapid development of the national economy was not obstructed,either.Perhaps these cannot be explained just by the suppression of labor protest in authoritarian states because recently the Chinese government has obviously adopted more moderate means to deal with labor strikes.So,what makes it possible for most labor strikes in China to have been peacefully solved relatively rapidly when the legal system is not perfect?The main reason is probably because of the unique governing means of China′s administrators,the Balance between Rules and Expediency.The governing means of the Rule-Expediency Balance,originated from the Confucian ideas of state governing,springs to life in the social environment in modern China.The actual practitioners of the governing means of the Rule-Expediency Balance,local government and local trade union,not only exert their efforts to make up for the deficiency of the current justice administration,but also strive to achieve an ultimate state of"the golden mean"in each dispute settlement in order to live up to the high standard of"harmonious labor relations"of the central government.
