摘要
数字版权保护是信息资源管理与服务的关键问题,也是信息资源管理领域研究的热点问题。以1995年发布《关于信息社会版权和邻接权的绿皮书》为起点,经过数字版权概念萌芽阶段(1995—2000年)、数字版权概念明确阶段(2001—2013年)、数字版权框架初建阶段(2014—2015年)、信息管理服务框架成型阶段(2016—2019年)后,欧盟于2019年4月17日正式发布《单一数字市场的版权指令》。版权指令的发布,是欧盟现代版权规则数字化、信息管理与服务体系规范化的必经阶段,也显示出欧盟数字版权保护中加重信息平台版权义务、明确传统信息生产者权利、平衡不同体量互联网平台、增加版权例外规则、接轨国际版权公约的变化趋势。
Digital copyright protection is not only the key problem of information resource management and service,but also a hot issue in the research field of information resource management.Starting from the publication of the Green Paper on Copyright and Related Rights in the Information Society in 1995,the proection of European digital copyright has roughly gone through four stages:proposing the concept of digital copyright(1995-2000),identifying the concept of digital copyright(2001-2013),building the framework of digital copyright(2014-2015),completing the framework of information management and service(2016-2019).Finally,on the 17 th of April 2019,the European Parliament and the Council of the European Union published the Copyright and Related Rights in the Digital Single Market and amending Directives.From the view of historical development,the directives present development trends as follows:increasing responsibilities of information platform,clarifying the rights of traditional publishers,rebalancing forces of different Internet platform,increasing copyright exception rules and integrating with international copyright treaties.
