摘要
新出台的《社区矫正法》规定了审前社会调查评估制度,但没有明确评估的具体时限,在实践中经常产生审前社会调查评估时限和案件审限的冲突。该冲突的实质是公平与效率的冲突,其主要原因是司法所人员力量薄弱、公检法司工作衔接不顺畅、社会公众参与度低以及调查启动的不确定等。为缓解时限与审限的冲突,需要加强司法所人财物保障;公安机关、检察机关真正落实审前社会调查相关职责,搭建公、检、法、司大数据共享平台以实现各部门有效衔接配合;加大宣传力度,用大数据技术辅助传统走访问答;确定"部分类型应当适用"的调查启动模式,对暴力型犯罪、性犯罪、毒品犯罪的犯罪人以及缓刑犯必须进行审前社会调查。
The newly issued social correction law stipulates the pre-trial social investigation and evaluation system,but it does not specify the specific time limit of the evaluation.The essence of the conflict is the conflict between fairness and efficiency,and the main reasons are the result of the weak judicial personnel,the unsmooth coordination of the work of the public inspection department,the low participation of the public and the uncertainty of the investigation.In order to alleviate the conflict between time limit and limit,it is necessary to strengthen the judicial personnel and property security;The public security organs and procuratorial organs really carry out the relevant duties of pre-trial social investigation,and build the big data sharing platform for public,procuratorial,legal and corporate departments to realize the effective coordination and cooperation among all departments.Increase publicity efforts,and use big data technology to assist traditional interview and question-and-answer;To determine the "some types should be applicable" mode of investigation initiation,the criminal who commits violent crimes,sexual crimes,drug crimes and the criminals on probation must be investigated before trial.
