摘要
《中华人民共和国档案法》法律效力的研究对其法律普适性和效力性的理论探讨具有重要的现实参考价值。本文以中国裁判文书网138篇文书为分析对象,首先以不同的标准对其分类进行了计量分析,然后从内容分析的角度对《档案法》在司法案件中实然效力的外在表征和内部表征展开了研究,最后得出了相关结论,以期为《档案法》的相关探讨提供有益的借鉴与启示。
The study of the legal effect of the Archives Law has important practical reference value for the theoretical discussion of its legal universality and effectiveness.In this paper,138 documents on China Referee Instrument Network are taken as the object of analysis.Firstly,the classification is analyzed by different standards.Then,from the point of view of content analysis,the external and internal characterization of the real effectiveness of the Archives Law in justiciary case is studied.Finally,the relevant conclusions are drawn in order to provide useful reference and enlightenment for the relevant discussion of the Archives Law.
