摘要
                
                    以房抵债是一种新兴的交易模式,由此引起的纠纷呈现出复杂多样的类型,但立法的滞后与司法解释的局限,尚难给以房抵债纠纷的解决提供统一适用的标准,出现类似案情不同判决结果的现象,给司法实务工作带来困惑。结合最高人民法院会议纪要、判例、公报案例及指导性案例,对以房抵债协议效力的类案裁判以类型化思维将其进行分类研究,通过分门别类提出效力判断及纠纷处理思路,力求使以房抵债纠纷能获得更多法律或司法解释的支持,从而使以房抵债协议纠纷解决于法有据。
                
                The housing-debt method is an emerging transaction mode,which has caused various kinds of disputes.Due to the hysteresis of legislation and the limitation of judicial interpretation,it is difficult to provide a unified applicable standard for the settlement of the housing-debt disputes.As a result,The phenomenon of similar cases with different judgment results brings confusion to judicial practice work.The author of this paper conducted a classified study on the housing-debt agreement and its validity with the typified thinking based on the minutes of meeting,judicial precedent and communique cases,and the guiding cases from the Supreme People's Court.The effectiveness judgment and ideas of dispute settlement were proposed in accordance with different categories.The author hopes that the housing-debt agreement can acquire more support from the laws and judicial interpretation to solve the disputes arising from the housing-debt agreement with lawfully recognized evidence.
