摘要
在人类社会的早期,真正意义上的国家尚未正式形成,私力救济在人类社会早期的各种救济手段中处于支配地位。伴随着私有制的产生和国家的出现,公力救济不断得到发展和完善,并逐渐取代私力救济,但不可否认的是,即便是在人类社会高度发展的今天,私力救济依然有着其存在的正当性基础,而且对公民合法权益的保护起着巨大的作用,因此,本文将结合我国当前的立法实际,在充分研究前人成果的基础上,结合自身所学,从理论与实践相结合的角度,浅析私力救济的立法现状、价值、困境以及建议等相关问题,并籍此为人们的行为提供指导。
In the early stage of human society,the real state has not been formally formed,and private relief is in a dominant position among various means of relief in the early stage of human society.With the emergence of private ownership and the emergence of the state,public relief has been continuously developed and improved,and gradually replaced private relief,but it is undeniable that even in the high development of human society today,private relief still has a legitimate basis for its existence,and plays a huge role in the protection of the legitimate rights and interests of citizens.Therefore,this article will combine with the current establishment of our country.In practice,on the basis of full study of previous achievements,combined with their own learning,from the perspective of theory and practice,this paper analyzes the legislative status,value,dilemma and suggestions of private relief,and provides guidance for people’s behavior.
