摘要
从党的十八届三中、四中全会到党的十九届四中全会,以习近平同志为核心的党中央对全面深化改革、全面依法治国到国家治理体系和治理能力现代化,进行战略决策、总体部署和系统安排。在治理现代化的视域下,改革、立法和治理的三者关系有了新的时代内涵,在中国之治的目标指引下,“新政”与“变法”互相扶持、相得益彰。在机构改革的新形势下,林业和草原部门职责得到重组优化,各项改革全面推进,对我国林草法律体系建设提出了新目标、新任务、新要求。有鉴于此,在梳理国家层面和省级层面涉林涉草立法情况、调查地方立法现状和开展专题调研的基础上,分析目前我国林草法律体系在立法和实践中存在的主要问题,主张突出林草融合的要求,推动我国林草法律体系改革步伐,加快实现林草治理现代化的目标。
From the third and fourth Plenary sessions of the 18th CPC Central Committee to the fourth Plenary session of the 19th CPC Central Committee,the CPC Central Committee with Comrade Xi Jinping as the core carries out strategic decision-making,overall arrangement and systematic arrangement for comprehensively deepening reform,comprehensively governing the country according to law,and modernizing the national governance system and governance.In the view of governance modernization,the relationship between reform,legislation and governance has a new connotation of the times.Under the guidance of the goal of China’s governance,the“New deal”and“Reform”support each other and complement each other.Under the new situation of institutional reform,the responsibilities of forestry and grassland departments have been reorganized and optimized,and various reforms have been comprehensively promoted,which puts forward new objectives,new tasks and new requirements for the construction of forest and grass legal system in China.In view of this,this paper analyzes the main problems existing in the legislation and practice of the current legal system of forest and grass in our country on the basis of combing the legislative situation,investigating the current situation of local legislation and carrying out special research at the national and provincial levels,and advocates highlighting the requirements of forest and grass integration,promoting the pace of reform of the forest and grass legal system in our country and speeding up the realization of the goal of governance modernization.
